Terms of Service
These Terms of Service ("Terms") govern your use of Bot for Kalshi (the "Service"), provided at botforkalshi.com. By creating an account, starting a subscription, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance & eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Service. By using the Service you represent that you (a) are 18 or older, (b) are a resident of a jurisdiction in which use of Kalshi and of automated trading tools is lawful, (c) are not located in, ordinarily resident in, or a national of any country subject to comprehensive U.S. sanctions, and (d) are not listed on any U.S. government list of restricted parties (including the OFAC Specially Designated Nationals list).
2. The Service
Bot for Kalshi provides software tools that let you create, configure, monitor, and run automated trading bots that interact with the Kalshi prediction-market platform on your behalf using credentials you provide. We are an independent service and are not affiliated with, endorsed by, or sponsored by Kalshi Inc. "Kalshi" is a trademark of its owner and is used here for identification only.
3. Accounts & security
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You must provide accurate information at signup and keep your contact email current.
- You agree to notify us promptly at support@botforkalshi.com if you suspect unauthorized access to your account.
- One person, one account. You may not create multiple accounts to evade limits, pricing, or enforcement actions.
4. API keys & trading authority
To run live trading bots you provide us with a Kalshi API key. By submitting your API key you grant Bot for Kalshi a limited, revocable license to use that key solely to execute, monitor, and report on trades that you have configured through the Service. We do not exercise discretion over your account, do not trade on your behalf outside of bots you have configured, and do not commingle funds. API keys are encrypted at rest using AES-256-GCM. You may revoke access at any time by deleting your key in the Service or by rotating the key in Kalshi. While we take reasonable security measures, no system is perfectly secure; you are responsible for safeguarding and rotating your own keys.
5. Subscription, billing & auto-renewal
- Price. The current published price for new subscriptions is $99 per month. Existing subscribers retain their original rate so long as they remain continuously subscribed; if you cancel and later re-subscribe, the then-current price applies.
- Billing cycle. Subscriptions are billed monthly in advance via Stripe, our payment processor. Stripe stores and processes your payment method; we do not store full card numbers on our servers.
- Taxes. Prices are exclusive of taxes; you are responsible for any sales, use, value-added, or similar taxes that apply to your subscription.
- Failed payments. If a charge fails, we may suspend access until payment is received. Repeated failure may result in cancellation.
- Price changes. We may change pricing for new subscribers at any time. We will give existing subscribers at least 30 days' notice by email before changing the rate on an existing subscription, and you may cancel before the change takes effect.
6. Refunds & cancellation
You may cancel at any time from your billing portal. Because the Service is provided on a month-to-month basis with no long-term commitment, refunds for partial periods are handled on a case-by-case basis at our discretion and are not guaranteed, except where required by law. If you believe you were charged in error, contact support@botforkalshi.com within 30 days of the charge.
7. Acceptable use
You agree not to, and not to permit anyone acting on your behalf to:
- Use the Service for any unlawful purpose, or in violation of Kalshi's terms of service or any applicable law or regulation;
- Reverse-engineer, decompile, disassemble, or attempt to derive source code from the Service, except to the limited extent applicable law expressly forbids restricting that activity;
- Scrape, copy, or systematically harvest content from the Service, or use any automated means (other than your own bots interacting with the Service as intended) to access the Service;
- Resell, sublicense, or otherwise commercialize access to the Service without our prior written consent;
- Create accounts using automated means or under false pretenses, or operate multiple accounts to evade limits or enforcement;
- Use the Service to manipulate, distort, or otherwise interfere with the integrity of any prediction-market or other financial market;
- Probe, scan, or test the vulnerability of the Service, or breach any security or authentication measures, except under a written security-research agreement with us;
- Interfere with or disrupt the Service, the servers or networks that host it, or any other user's enjoyment of it; or
- Use the Service in any manner that infringes the intellectual-property or other rights of any third party.
8. Kalshi compliance
You are solely responsible for maintaining a Kalshi account in good standing and for complying with Kalshi's own terms of service, trading rules, and applicable regulations (including CFTC rules where they apply to your activity). Suspension, restriction, or termination of your Kalshi account does not entitle you to a refund from us, except where required by law. We may, but are not obligated to, suspend Service access if we have a reasonable basis to believe your activity violates Kalshi's rules or applicable law.
9. Not financial advice
The Service is a tool. Nothing provided by Bot for Kalshi — including bot templates, signal definitions, strategy descriptions, performance statistics, blog posts, emails, or in-app text — constitutes investment advice, financial advice, trading advice, tax advice, or legal advice, and none of it should be relied on as such. You alone are responsible for evaluating whether any trade or strategy is appropriate for you, and you alone bear the consequences of your trading decisions.
10. Trading risk
- Trading prediction-market contracts involves substantial risk of loss and is not suitable for everyone.
- Automated trading can amplify losses as well as gains. A misconfigured bot, an unexpected market move, a network outage, an API change, a bug, or a third-party failure can cause unexpected losses.
- Past performance — whether of a strategy, a bot template, a market, or any user — does not guarantee future results. Backtest, paper-trade, or sample numbers are estimates that may differ materially from live results.
- You are solely responsible for monitoring your bots, setting your own risk limits, and managing your exposure.
11. Intellectual property
The Service, including all software, content, designs, logos, and trademarks (other than third-party marks identified as such), is owned by us and is protected by U.S. and international intellectual-property law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during the term of your subscription, subject to these Terms. Any rights not expressly granted here are reserved.
You retain ownership of any configurations, strategies, or other content you create within the Service ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, and display Your Content solely as needed to operate the Service for you, to improve the Service in aggregate and anonymized form, and to comply with legal process.
12. DMCA & copyright
If you believe content on the Service infringes your copyright, please send a notice under 17 U.S.C. § 512(c) to support@botforkalshi.com with the subject line "DMCA Notice." Your notice must include: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) the URL or location of the allegedly infringing material; (d) your contact information; (e) a statement that you have a good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on the copyright owner's behalf. We respond to valid notices and may terminate repeat infringers.
13. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. To the maximum extent permitted by law, Bot for Kalshi and its suppliers disclaim all warranties, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted or error-free operation, and that the Service will meet your requirements or be compatible with any particular hardware, software, or third-party service (including Kalshi). We make no warranty that any bot, signal, or strategy will be profitable.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL BOT FOR KALSHI, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR TRADING LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
15. Indemnification
You agree to defend, indemnify, and hold harmless Bot for Kalshi and its owners, officers, employees, and agents from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of Kalshi's rules or any applicable law or regulation; (d) Your Content; or (e) your trading activity and any resulting gains or losses.
16. Termination
You may terminate by cancelling your subscription and deleting your account. We may suspend or terminate your access at any time, with or without notice, for any reason, including suspected violation of these Terms, abuse of the Service, failure to pay, suspected fraud, or risk to us or to other users. On termination: your right to use the Service ends immediately; your encrypted API keys are deleted; and the provisions of these Terms that by their nature should survive (including Sections 11–15, 17, 18, and 20–21) will survive.
17. Arbitration & class-action waiver
Agreement to arbitrate. You and Bot for Kalshi agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Dispute") will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules then in effect, except as modified here. The arbitration will be conducted by a single arbitrator. The seat of arbitration is the United States; hearings (if any) may be conducted by video or in a mutually agreed location, or, at your election if you are a consumer, in the U.S. county where you reside.
Class-action waiver. You and Bot for Kalshi each waive the right to bring or participate in any class, collective, or representative action. The arbitrator may award relief only on an individual basis and may not consolidate the claims of multiple persons or preside over any form of representative or class proceeding. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and proceed in court; the remainder will be arbitrated.
Exceptions. Either party may bring an individual action in small-claims court for claims within that court's jurisdiction, and either party may seek injunctive or other equitable relief in court to protect its intellectual-property rights. Filing such an action does not waive the right to arbitrate other claims.
Costs. Each party pays its own costs unless the arbitrator orders otherwise or unless JAMS' consumer-arbitration minimum standards require us to advance fees. Nothing here prevents an arbitrator from awarding fees or costs as authorized by law.
18. Governing law
These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws principles. Subject to Section 17 (Arbitration), any action that may properly be brought in court will be brought exclusively in the state or federal courts located in Utah, and you consent to the personal jurisdiction of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
19. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will notify you by email and/or by posting an in-app notice at least 30 days before the change takes effect (or sooner where required by law or where the change is to your benefit). The "Effective date" at the top reflects the latest version. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. Prior versions are available on request.
20. Miscellaneous
- Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
- Severability. If any provision is held unenforceable, the remainder will continue in full force, and the unenforceable provision will be enforced to the maximum extent permitted.
- No waiver. Our failure to enforce a right is not a waiver of that right.
- Assignment. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, financing, reorganization, or sale of assets.
- Notices. We may give you notices by email to the address on your account or by posting them in the Service. You may give us notice at support@botforkalshi.com.
- Force majeure. Neither party is liable for failure or delay caused by events beyond reasonable control, including network outages, third-party-provider failures (Kalshi, Stripe, cloud hosts), denial-of-service attacks, natural disasters, or government action.
- Relationship. Nothing in these Terms creates a partnership, joint venture, agency, fiduciary, or employment relationship between you and us.
- Headings. Section headings are for convenience only and do not affect interpretation.
